New Domestic Helper Law Protects Rights of All Parties
The new rule on local helpers targets to regulate the employment rapport of local helpers in the United Arab Emirates, along with set and balancing the rights and duties of all concerned groups included, the Ministry of Human Resources and Emiratization stated on Tuesday.
Under the new rule, which would come into action on 15th December 2022, local helpers cannot stand recruited from their country of origin prior to standing informed of the nature of performance and the salary, along with presenting proof of their fitness, health, psychological, and expert competence to accomplish the work needed.
Recruitment offices, whether directly or via external groups, are banned from accepting a commission in return for getting work or charging any costs from the local helpers.
The decree also covers the duties of recruitment professionals, which comprise humanely treating local helpers, not exposing them to brutality, and increasing their familiarity with the concerned authorities they should contract in case their rights are violated.
Agents have to also give local helpers a brochure with knowledge about their compensation or other connected details to assure that they fetch the appropriate salaries, in line with the tools decided by more.
Recruitment agents should cover the expense of replacing local helpers in their nations of origin and either offer a replacement helper or reimburse the portion paid by the employer, in line with the determinations granted by the ministry.

The decree-law determinates the duties of employers, which comprise supporting the exemplary climate for performing the contracted performance, showing appropriate residing vicinity for the local helpers; giving food and right clothing to make capable the helpers to work their obligations as prolonged as they were established on a complete-time ground and not on contract based, except in case arranged otherwise.
The duties of employers even comprise making the payment of salaries of local helpers according to their agreements; covering the expenses of medical treatment for local helpers under the structure of the health schedule of the UAE; treating local workers in a way that keeps their innocence and elegance.
Moreover, the employer cannot create local employees to work for others except in case it is a portion of the terms as mentioned in the administrative order of the decree-law and the determinations granted by MoHRE.
The employer is even banned from hiring any local worker unless he or she is authorized to accomplish it. Plus, the local worker must not stand asked to perform for others or in an occupation distinct from the nature of his work specified in the work permit, except beneath the worker’s consent and in case this is one of the occupations specified in the executive rules of this decree-law.
The decree provides the local worker the right to maintain their own identification papers while issuing the heirs of the local workers who died throughout the service the salary for the month in which they died and another entitlement.
The decree dealt with the duties of the local workers, as this mentioned that they should act on the tasks as per the direction of the employer and as per what is mentioned in the agreement, take essential care, and not control performance without an acceptable excuse, moreover to observing the customs and conventions of the country society and complying with public ethics and the tools of the employer about the execution of the agreed performance unless this violates the agreement, the rule, public ethics, or what exposes it to danger or lawful accountability.
The local worker should also respect the privacy of the office, preserve the property of the employer, work equipment, and everything in his custody, not utilize them outside work except with the sanction of the employer, and not perform under any form except beneath a work permit granted to them by the ministry and as per the applicable terms.
The new rules specify that the recruitment or temporary employment of local workers will stand not permitted unless after getting a license from the ministry and that the recruitment of local workers would stand not allowed except as per the terms and processes mentioned in the law.
This also mentioned that the recruitment of local workers under the age of 18 is banned, and in the case of the recruitment of local workers, there should stand no discrimination amongst them based on race, sex, nationality, religion, social position, or disability, which will decrease equal prospects or prejudice equality in getting or constantly running a job and enjoying its rights. This even controls any form of forced work or any usefulness that falls under the structure of human trafficking as per the rules granted by the nation or ratified contracts.
As per the law, the local worker is entitled to a weekly rest day as decided by the administrator rules of this law. The worker can stand employed on their weekly off day but in this term, there are authorized to an optional rest day or a cash balance to that day, and the worker’s regular rest should not stand less than 12 hours in a day, subject to a minimum of around 8 constant hours rest.
