UAE Announces Penalties for Offences by Public Benefit Institutions

UAE: The UAE government has recently introduced new rules that outline penalties for public benefit institutions that break or don’t follow the rules. The decision is a part of Federal Decree-Law No. 50 of 2023, which governs how such organizations should operate. 

Under the new framework, if a public benefit institution breaks the rules, it has to face fines that can range from AED 1,000 to AED 30,000, depending on the severity of the violation. Common violations under the new system include not informing authorities about important changes in operations, participating in events without approval, and misusing funds. 

New UAE Penalties & Fines for Public Benefit Institution Violations 

The Emirati government has announced a list of actions that will be considered violations from now on to make sure the public benefit institutions follow the updated rules. The primary purpose of these penalties is to prevent misuse of resources and keep operations within the country compliant with the law. Here is a list of key violations and their penalties for the updated UAE public benefit institution law: 

1. Not Reporting Internal Changes

If a public benefit institution fails to notify authorities about changes made within the institution, it will receive a warning for the first and second violations. However, if the offence is committed for the third time, a fine of AED 1,000 will be imposed, and if it is repeated for the fourth time, it might lead to the temporary closure of the institution for one month.

2. Joining Events Without Approval 

Under the new UAE public benefit institution law, participating in events without permission from the authority will result in a warning for the first time. However, for the second violation, the public benefit institution will be imposed with a fine of AED 1,000, which will increase to AED 2,000 for the third offence, and if the violation is repeated for the fourth time, it can lead to a one-month temporary closure. 

3. Hosting Guests Without Approval

Inviting people from within the Emirates to attend or speak at events without approval results in a warning for the first offence, an AED 1,000 fine for the second violation, and an AED 2,000 fine for the third offense. 

4. Hosting Overseas Guests Without Approval

Hosting people from outside the UAE for events within the country without permission results in an AED 2,000 fine for the first offence and an AED 4,000 fine for repeated offences. However, if this violation is repeated for the third and fourth times, the public benefit institution will be fined AED 6,000 and might have to face a one-month temporary closure. 

5. Joining Foreign Activities Without Approval

If a public benefit institution participates in activities organized by foreign associations, it will be imposed with a fine of AED 5,000 for the first offence, which will increase to AED 10,000 and AED 15,000 for the second and third violations, respectively. 

6. Unauthorised Membership in Foreign Organizations

Any public benefit institution of the UAE found affiliated with any foreign organization without local ministry approval will face a fine of AED 10,000 for the first offence, which will increase to AED 20,000 for the second, and AED 30,000 for the third time. 

7. Mismanagement of Funds

Under the updated UAE public benefit institution law, misuse or improper handling of funds is also considered a violation, and for this offence, the authority will give a warning to the institution for the first offence. However, if this is repeated, a fine of AED 5,000 will be imposed on the institution, and for the third offence, the fine will be increased to AED 10,000. 

The newly announced UAE cabinet’s resolution highlights the importance of adherence to regulations and the government’s strong focus on improving transparency and accountability in the sector. All the public benefit institutions are encouraged to familiarize themselves with the updated rules so that they don’t have to face fines and they can maintain operations compliant with the nation’s standards.
